Q: What is the deadline to file my appeal?
A: It depends, and it is complicated and each case is different. The short, general answer is: file your post trial motions within 10 days of verdict and/or sentencing and file the appeal within thirty (30) days of denial of the post trial motions. But remember, each case is different and the above answer may not apply to your case. Never wait until the last minute to file your appeal.
Q: What is the deadline to file my petition for post conviction collateral relief?
A: It depends upon whether you were convicted by guilty plea, or by jury verdict and whether or not you filed a direct appeal with the Mississippi Supreme Court.
Q: What is the difference between a direct appeal and a petition for post conviction collateral relief?
A: Anyone convicted by jury of a felony offense in the State of Mississippi has a statutory right to one direct appeal to the Mississippi Supreme Court. Most of the direct appeals are sent by the Mississippi Supreme Court to the Mississippi Court of Appeals. The direct appeal typically challenges the sufficiency of the evidence and certain rulings made by the judge during the trial. There is no direct appeal, however, if the defendant plead guilty. A person who is convicted by a guilty plea, however, may file a petition for post conviction collateral relief (PCCR). Also, persons convicted by jury and who have filed their direct appeal, which was denied, may then file for PCCR. Petitions for PCCR often complain of ineffective assistance of trial counsel and sometimes claim that there is newly discovered evidence pointing towards innocence. There could also be other grounds for relief.
Q: What is the cost of filing an appeal or petition for PCCR?
A: Cost varies from case to case. A simple appeal on a simple matter could be as low as $7,500.00, where a more complicated matter might be several times that. One thing is for sure though, if you base your decision regarding what law firm to retain upon the one that is the cheapest, you'll wind up with the cheapest lawyer in town. Is that really who you want? Can you afford more of the same? Financing is available.
